Avandia Lawsuit Statute of Limitations Motion is Denied

Avandia MDL Judge Cynthia Ruth has denied a motion to dismiss over sixty Avandia Lawsuit claims for statute of limitations. GlaxoSmithKline, the maker of controversial diebietes durg, Avandia argued that patients should have been aware of Avandia side effects in May 2007.

In May 07 the New England Journal of Medicine released a study linking Avandia to side effects including Heart Attack and congestive heart failure.

GSK is arguing that Avandia Lawsuit Statute of Limitations should have begun in May 2001. Avandia Claims Statute of Limitations rules where these claims were file (Pennsylvania) is 2 years.

In the ruling it was reported GSK argues that a “storm of media attention about Avandia in May-November 2007” should have put the plaintiffs on notice to investigate the cause of their injuries.

The patients in this Avandia lawsuit reported argued they had now knowledge of the risks between Avandia and Avandia heart attack risk until 2010.

FDA Reports Increased Risk of Blood Clots from Yaz Use

The FDA recently reported on September 27th, that it "remains concerned" that newer birth control devices such as Yaz may be linked to increased risk of Blood Clots. The FDA reports that women who use Yaz and other new birth control devices are at 150% more risk than women who don't use these devices. The FDA study reporting involved over 800,000 women.

In a statement released by the FDA, "The FDA is informing the public that it has not yet reached a conclusion, but remains concerned, about the potential increased risk of blood clots for women who use drospirenone-containing birth control pills."

The FDA will hold another series of meetings around December 8th to further review Yaz side effects, lawsuits and claims.

Back in May, the FDA announced is was reviewing the side effects of Yaz after 2 studies were released tying Yaz to blood clots. These studies indicated that products including Drospirenone. Other drugs that include Drospirenone include Loryna, Gianvi, Safyral, Ocella, Syeda, Zarah, Beyaz.

Surgical Mesh Claims News: FDA to Possibly Call for More Testing

The FDA meet for 2 days earlier in September to determine if vaginal mesh or surgical mesh may need to be reclassified as a "High Risk" surgical medical device. Surgical or transvaginal mesh devices were cleared under the 510(K) process. The 510(K) process allows products to be approved without extensive studies if the product "substantially equivalent" to other products in the market. Surgical Mesh Claims and side effects have been on the FDA radar since October of 2008 when the FDA sent letters to surgeons and medical professionals advising them on the potential side effects of Surgical Mesh Devices.

Reportedly from these most recent Surgical Mesh FDA meetings, a number of surgical mesh manufactures agreed that future versions of surgical mesh should face more stringent testing. Also it was discussed that labeling changes should be made to Trans Vaginal Mesh in order to warn of side effects a patient can suffer. To date of this page update, no ruling has been made in terms of changing surgical mesh to a “high risk” category. However, it appears that more testing may be required into order for new versions of surgical mesh to be allowed on the market. During the FDA trans-vaginal mesh meetings, Piet Hinoul a director at Johnson and Joshson (makers of mesh devices) noted transvaginal mesh is not “ the optimal solution for everyone.” Mr. Hinoul also remarked that surgical mesh could be an solution for a few.

The FDA has received numerous complaints regarding surgical mesh over the years in addition to surgical mesh claims being made via surgical mesh lawsuits in the courts. The FDA previously reported from 2005 - 2008 a thousand reports were filed from almost 10 different surgical mesh manufacturers that complications were associated with Surgical Mesh devices. It is noted that the FDA received over 1,500 reports of complications from surgical mesh devices from 2008 to 2010.

If the FDA does classify Surgical Mesh Devices as” high risks”, the marketers and the manufacturers of these products will have to conduct studies on post market medical trends, and provide that information to the FDA to review.

RICO Lawsuit Filed Against Henderson County & FEMA, Among Others

June 22nd, 2011 – Henderson County, IL – On Friday, attorneys representing Jesco Disaster Services filed a lawsuit alleging that several parties, including Henderson County, FEMA, IEMA and the Henderson County Board of Supervisors illegally conspired to avoid paying an invoice provided by Jesco for services rendered following the historic Flood of 2008.

Beginning on July 17th, Jesco was contracted by Henderson County to pump 60-70 billion gallons of water out of the ground and into the Mississippi River. Over the course of six weeks, Jesco completed the job and invoiced the county for nearly $30 million dollars, which Jesco has yet to recover.

County officials have claimed that “red tape” and the need to fully audit the invoices are responsible for the non-payment, but the lawsuit alleges an organized conspiracy on the part of local officials and government agencies to avoid paying Jesco.

The contract between Henderson County and Jesco, was unanimously approved by the Board of Supervisors. However, FEMA officials attempted to get the county to break the contract because the cost estimate prepared by the county – which included equipment only, rather than manpower - was significantly lower than the final cost, despite FEMA’s own attorneys deeming the original contract valid.

Henderson County Board Chairman Marty Lafary continues to cite “red tape” and due diligence as the reason for non-payment, but witnesses to public board meeting attest to hearing Mr. Lafary state that the county never had any intention of paying Jesco from day one.

The lawsuit cites several incidents to supports its case, ranging from the falsifying of information, the use of improper accounting measures and deliberate acts to improperly void the contract between Henderson County and Jesco.

Lead Attorney Gary Riebschlager of Brent Coon & Associates said, “What we have here is a clear cut cases of a large group of individuals from various agencies distorting and misrepresenting the facts of this case and the terms of this contract in order to skirt their financial obligations to Jesco. Jesco was hired by the county to provide emergency relief for the people of Henderson County during an extremely difficult time period and Jesco performed the services under good faith. To attempt to retroactively void the contract with a company who was so integral in helping the area fully recover isn’t how business is done in this country.”

The lawsuit seeks full payment for services rendered in addition to attorneys fees and punitive damages.

Avandia Class Action Filed in Illinois

An Avandia Class Action lawsuit was filed in St. Clair County Circuit Court by 43 plaintiffs last month in the state of Illinois. The suit claims the 43 plaintiffs in the avandia class action were failed proper warning from GlaxoSmithKline regarding Avandia's side effects. Side effects of Avandia has included heart attack and congestive heart failure. Thousands of reported Avandia lawsuits have been filed throughout the country since Avandia (rosiglitazone) was introduced in 1998.

Avandia Class Action in Illinois

The latest class action lawsuit was entered on 5/4 and against GlaxoSmithKline, SmithKline Beecham Corporation, McKesson Corporation and five other defendants. The Avandia Class Action lawsuit claims that the Avandia manufacture is guilty of negligence, fraud, breach of warranty and misrepresentation. It's been reported this Avandia class action lawsuit is asking for Avandia claim damages in excess of $650,000.
Earlier this month the FDA decided to pull Avandia off the shelf starting this Nonmember. The controversial diabetes drug will only be available through a special program called the Avandia-rosiglitazone Medicines Access Program. A portion of the Avandia statement made by the FDA includes:
